Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you", "user") and SongWishes, a sole proprietorship registered in India, the operator of the Clarity ProMax application and website (the "Service"). By creating an account, making a payment, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Clarity ProMax is an Eisenhower-matrix task tracker that helps you sort and prioritise tasks and, with your permission, logs them to a Google Sheet in your own Google account. We may add, change, or remove features over time.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to enter into a binding contract. You sign in using Google. You are responsible for keeping your account secure and for all activity that happens under it. You must provide accurate information and keep it up to date.

3. Payment, access and pricing

Clarity ProMax is a paid product. Access to the application is unlocked once your payment is successfully received. Prices are listed on our pricing page and are shown in Indian Rupees (INR) unless stated otherwise. Applicable taxes may be added at checkout. Payments are processed by third-party payment gateways, and your use of those services is also subject to their terms. We do not store your full card or bank details.

Unless described as a recurring subscription at the time of purchase, a purchase grants access for the stated period (for example, one year). Where a plan renews, we will make the renewal terms clear before you are charged.

4. Refunds

Clarity ProMax is a digital product and access is unlocked immediately on payment. Because of this, all sales are final and payments are non-refundable. Please make sure Clarity ProMax is right for you before you buy, and read this page and our product pages first. If you were charged in error, or you believe something went wrong with your payment, email us at claritypromax@gmail.com and we will look into it.

5. Sponsor-a-student plans

If you buy a plan that includes sponsoring a student, part of your payment funds free access for a student. You will not receive anything additional in return for the sponsored portion beyond what is described on the pricing page, and the sponsorship is provided on a good-faith, best-effort basis.

6. Your content and your Google data

Your tasks, goals, and the Google Sheet created for you remain yours. You grant us only the limited access needed to operate the Service, as described in our Privacy Policy. You are responsible for the content you enter and for ensuring you have the right to store it.

7. Acceptable use

You agree not to misuse the Service, including: reselling or redistributing access without permission; attempting to break, overload, reverse-engineer, or gain unauthorised access to the Service; using it for unlawful purposes; or interfering with other users.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data sync with Google will always be instantaneous or complete. We make no guarantee of any career, financial, or personal outcome (see section 14).

9. Limitation of liability

To the maximum extent permitted by law, SongWishes and its proprietor will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost opportunities, or lost data, arising from your use of, or inability to use, the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim arose.

10. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to us or other users. You may request deletion of your account and data as described in the Privacy Policy.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of India. Subject to applicable law, the courts at Bengaluru, Karnataka will have jurisdiction over any disputes.

14. No guarantee of promotion or any outcome

Clarity ProMax is a tool. It does not, and cannot, guarantee that you will be promoted, get a raise, get noticed, or achieve any specific career, financial, or personal result. Whether you get promoted depends on the work you choose to do, how well you define and manage your tasks, and the context only you have about what actually matters in your role and organisation. The Service helps you make your priorities and your work visible, it does not do the work for you and it does not influence any decision made by your employer. Any examples, testimonials, or outcomes shown on our site are illustrative and are not promises of results.
